These Terms & Conditions govern all services provided by Fusion Tech Solution (“we”, “us”, “our”). By engaging us, requesting a quote, making a payment, or otherwise using our services, you (“client”, “you”) agree to be bound by these terms. If you do not agree, please do not proceed with an engagement.

We provide design, development, and technology services including but not limited to branding, website and e-commerce development, mobile and software applications, SEO and AI-search optimisation, automation, cloud and infrastructure consulting, and ongoing support and maintenance. The specific deliverables for your engagement are those set out in your individual quote, proposal, or statement of work.

Prices referenced anywhere on this website — including the pricing page, service pages, and homepage — are indicative only. They are published to give you a general sense of cost and do not constitute a binding offer.

The final price for any engagement depends on your specific project requirements, scope, complexity, timeline, integrations, third-party costs, and level of ongoing involvement. We reserve the full and absolute right to provide you with a quote that differs from the pricing displayed on this website, whether higher or lower.

A price becomes binding only once it is confirmed in writing by us in a formal quote, proposal, or invoice and accepted by you. Quotes are valid for 30 days from the date of issue unless stated otherwise. Prices are exclusive of applicable taxes (including GST) unless expressly stated.

Unless agreed otherwise in writing, project work begins on receipt of an advance payment. The remaining balance is payable at the milestones set out in your quote, with the final payment due before final delivery, handover, or deployment of source files and credentials.

Recurring services (such as hosting, support, and maintenance) are billed in advance for the agreed period. Late or missed payments may result in work being paused and, for recurring services, suspension of the service until the account is brought current.

Each engagement includes the deliverables and the number of revision rounds stated in your quote. Requests that fall outside the agreed scope — additional pages, features, integrations, redesigns, or revision rounds — will be treated as new work and quoted separately before we proceed. We will always tell you when a request is out of scope.

You agree to provide, in a timely manner, the content, assets, access, approvals, and feedback we need to deliver the work. You confirm that any material you provide to us does not infringe the rights of any third party. Delays in providing what we need may affect the timeline and, in some cases, the cost of your project.

Timelines shared with you are good-faith estimates based on the agreed scope and prompt client input. They are not guarantees. We are not liable for delays caused by factors outside our reasonable control, including late client feedback, third-party service issues, or changes to scope.

On receipt of full payment for an engagement, ownership of the final deliverables produced specifically for you — source code, designs, and content — transfers to you. We retain ownership of any pre-existing tools, libraries, frameworks, and know-how used to build them, and we may reuse that general knowledge on other projects. Unless you ask us not to, we may reference the completed work in our portfolio.

Projects may rely on third-party platforms, services, APIs, plugins, domains, or licenses (for example hosting, email, payment gateways, and SaaS subscriptions). The cost of these is separate from our fees unless expressly bundled, and they are governed by their own providers' terms. Renewal and usage costs for these services are your responsibility once the project is handed over.

Where hosting is included with a package, it is provided for the stated introductory period, after which renewal is charged at our then-current rate. Support and maintenance plans cover the activities described in your quote during the subscription period. Work not covered by a plan is quoted separately.

We warrant that our services will be performed with reasonable skill and care. Beyond that, services and deliverables are provided “as is”. We do not warrant that software will be uninterrupted or error-free, or that any particular business, search-ranking, or revenue outcome will be achieved.

To the maximum extent permitted by law, our total liability arising out of or in connection with an engagement is limited to the total fees paid by you for that engagement. We are not liable for indirect, incidental, or consequential losses, including loss of profit, revenue, data, or goodwill.

Each party agrees to keep the other party's non-public information confidential and to use it only for the purpose of the engagement. This does not apply to information that is or becomes public through no fault of the receiving party, or that must be disclosed by law.

Either party may terminate an engagement with written notice. On termination, you are responsible for payment for all work completed and commitments made up to the termination date. Advance payments cover work already performed and are non-refundable to that extent. Recurring services may be cancelled before the next renewal date; fees already paid for the current period are not refunded.

These terms are governed by the laws of India. The courts of Ahmedabad, Gujarat have exclusive jurisdiction over any dispute, subject to the parties first attempting to resolve it in good faith.

We may update these terms from time to time. The version in effect for your engagement is the one published on this page at the date your quote is accepted. Continued use of our services after an update constitutes acceptance of the revised terms.
